§ 48-781. Title; enactment; purpose.

(a)

This article shall be known as "The Village at Nags Head SPD-C Zoning Ordinance." This article is adopted pursuant to section 48-443 entitled, "special planned development-community district."

(b)

In accordance with the provisions of G.S. 160A-360 et seq. and section 48-443, an application having been made for the rezoning of approximately 410 acres of land known as the Epstein Property and defined as described in this article as "The Village at Nags Head."

(c)

The planning board and the board of commissioners have reviewed the application and found that the application complies with the terms of this chapter, and the board of commissioners finds this as a fact.

(d)

There is created a special planned development-community district pursuant to the terms of section 48-443 which shall be designated as "The Village at Nags Head."
