§ 38-91. Submission; resubmission on rejection; form and contents.

  • (a)

    The subdivider of either a minor or major subdivision shall submit copies of the final plat to the secretary of the planning board at least 25 days prior to the date of the regular planning board meeting at which the plat will be reviewed. The time of submission shall be within one year of the approval of the preliminary sketch of a minor subdivision or preliminary plat of a major subdivision, or within six months following completion of the construction of improvements, only if such construction was commenced within one year of the approval of the preliminary sketch or preliminary plat, as the case may be, but in no case more than three years and six months after approval of the preliminary sketch or plat, unless such time has been extended by the planning board in accordance with section 38-61, in which case the time shall be within six months following completion of construction, or the time as extended, whichever is less. Failure to meet such time requirements shall constitute automatic rejection of the final plat, in which case the subdivider, at his option, may resubmit the final plat as a preliminary plat in accordance with section 38-64(b), if for a major subdivision, or as a preliminary sketch in accordance with section 38-64, if for a minor subdivision.

    (b)

    The number of copies of the final plat required for submittal shall be determined by the planning and development department. If a separate plat is provided to show engineering data, the planning and development department shall determine the number of copies of the engineering plat that shall be required.

    (c)

    The final plat shall contain all information required in section 38-65, including a certificate of final approval of the water facilities as constructed and excepting those streets and easements of right-of-way for utilities and the public which existed prior to subdividing and which are removed from the subdivision as finally constructed.

    (d)

    The subdivision plat, or engineering plat, shall show the exact location of all utilities and the boundaries of the easements of right-of-way for all utilities including, but not limited to, water lines, mains and valves, sewer lines, mains and valves, surface and subsurface electric and telephone and cable television lines and conduit, street lighting and related electric wiring and conduit, storm drains and mains, natural gas lines and fire hydrants. The exact location of these utilities may be shown at the expense of not showing other information as required on the final plat, since clarity is necessary, except that street and lot boundaries must be shown.
