§ 2-1. Zoning; boundary extension; establishment; application.

  • (a)

    Extension of boundary. The zoning map of the town is hereby amended so as to extend the zoning boundary for a distance of not more than one mile from the corporate limits, as shown on a zoning map of the extraterritorial zoning area of the town dated May 4, 1987, and subsequently amended, such boundary being described as follows:

    (1)

    Area 1. Beginning at a point where the town limit line and the centerline of U.S. 64/264 intersect, such point being on or at the eastern edge of the Washington Baum Bridge, as realigned in 1990, and hereafter referred to as the New Washington Baum Bridge; thence, with the centerline of the New Washington Baum Bridge in a westerly direction approximately 2,000 feet to a point; thence, in a southerly direction along a line perpendicular to the centerline of the New Washington Baum Bridge for a distance of 5,280 feet to a point; thence, in an easterly direction along a line located 5,280 feet from and parallel to the centerline of U.S. 64/264 and the New Washington Baum Bridge and the Melvin R. Daniels Bridge (the little bridge connecting Pond Island with a portion of U.S. 64/264, known as the Causeway) for a distance of 12,500 feet to a point where such line intersects the town limit line as it runs along the rear of property located on the west side of S.R. 1243; thence, in a northerly direction; and thence, in a westerly direction along such town limit line to the point of beginning.

    (2)

    Area 2. Beginning at a point where the town limit line and the centerline of U.S. 64/264 intersect, such point being on or at the eastern edge of the New Washington Baum Bridge; thence, with the centerline of the New Washington Baum Bridge in a westerly direction 2,000 feet to a point; thence, in a northerly direction along a line perpendicular to the centerline of the New Washington Baum Bridge for a distance of 5,280 feet to a point; thence, in an easterly direction along a line 5,280 feet from and parallel to the centerline of U.S. 64/264 and the New Washington Baum Bridge and Melvin R. Daniels Bridge for a distance of 3,000 feet to a point; thence, in a northerly direction along a line 5,280 feet from and parallel to the mean high waterline of the Roanoke Sound, such mean high waterline being the western town limits of the town until such line forms a point of intersection with another line, such line being a projection of the northern town limit line 5,280 feet westerly from the mean high waterline; thence, in an easterly direction along such projected town limit line 5,200 feet to the mean high waterline; thence, in a southerly direction following the town limit line to the point of beginning.

    (3)

    Area 3. Beginning at the point of intersection of the Nags Head-Atlantic Township line with the Atlantic Ocean, such point being also the southeast corner of the corporate limits of the Town of Kill Devil Hills, in Dare County, North Carolina, and running thence from the beginning point in a general southeasterly direction along the mean high waterline of the Atlantic Ocean, being the town limit line, to the northeast corner of the lands of the United States of America on Bodie Island, which such lands form a portion of the Cape Hatteras National Seashore Recreational Area, such point also being the southeastern corner of the corporate limits of the Town of Nags Head; thence, along a line in a general easterly direction from the mean high waterline for a distance of 5,280 feet to a point along an eastern projection of the southern town limit line to a point in the Atlantic Ocean; thence, in a northwesterly direction along a line 5,280 feet parallel to the mean high waterline of the Atlantic Ocean until such line forms a point of intersection with another line, such line being the projection of the northern town limit line 5,280 feet easterly from the mean high waterline; thence, in a westerly direction along such projected town limit line 5,280 feet to the point of beginning.

    (4)

    Area 4. Beginning at a point, such point being the southwest corner of the corporate limits of the Town of Nags Head, same also being the southwest corner of Bodie Island Subdivision, as recorded in the Dare County Register of Deeds, Map Book 9, Page 45, and running thence from the beginning point in a western projection of the southern town limit line for a distance of 5,280 feet to a point in the Roanoke Sound; thence, in a northwesterly direction along a line 5,280 feet from and parallel to the west town limit line, same also being 281 feet west of the west margin or right-of-way of S.R. 1243 and the eastern boundary of the lands of the United States of America, until such line forms a point of intersection with another line, such line being a line 5,280 feet south of and parallel to the centerline of US 64/264; thence along such line in an easterly direction to a point where such line intersects the western town limit line as it runs along the rear of the property located west of the west side of NCSR 1243; thence in a southerly direction along such town limit line to the point of beginning.

    (b)

    Establishment of zones. The areas lying outside of and beyond the corporate limits as shown on the map of the extraterritorial zoning area of the town and as described in subsection (a) of this section are hereby divided into zones or districts in accordance with such map and description, and the provisions of the town zoning ordinance are hereby made applicable in every respect for each of the zones within this extraterritorial area as indicated on the zoning map.

    (c)

    Applicability of ordinances relative to zoning, subdivisions and buildings to extraterritorial area. The zoning, subdivision and building chapters of the town shall be applicable in every respect within the extraterritorial area in the same manner as they are now applicable within the corporate limits, and the building inspector (or other appropriate official) shall enforce all of the provisions of such ordinances within the extraterritorial area in the same manner as he is authorized to enforce such ordinances within the corporate limits.
